Release of Liability

For carrying out bicycle sport activities, bicycle rental and tourist tours, organized by HOLIDAYS and BIKE S.R.L.S. (hereinafter “H&B”) C.F. / VAT number 03938180134 represented by the pro tempore legal attonery with use of the registered trademark owned by him.

The Customer Declares and signs

  1. to have been correctly informed about the possible risks connected to the practice of the practicable sports disciplines with the bicycle;
  2. to be in good health and to exonerate H&B from any liability, whether civil or criminal, relating to or resulting from the assessment of such eligibility;
  3. to have good cycling skills and driving practice; to be in good physical conditions
  4. to have received all the appropriate equipment to perform the agreed activities, including safety equipment as signalling lights
  5. to endeavour every effort not to overtake the guide during the sport activity, to follow all the indications and not to take other alternative routes, and no other initiative if not shared with the guide;
  6. to have been informed and to accept the Italian traffic regulations (D.lgs. 30 aprile 1992, n. 285), especially: to respect the road signs, to keep the right, to ensure a safe behavior, especially in proximity of the roundabouts, road crossing, turns, downhill and comply with the indications stated in article n. 182 D.lgs. 30th April 1992, as I have read all the provisions below:
    1. Cyclists must move in single line and never more than two people side by side; when they’re outside the city center they must progress in a single line except in case there’s a Child aged less than 10 years, the child must keep the right; 1.bis the measures set out in paragraph 1 do not apply on the urban road cycleway;
    2. Cyclist must have free hands and keep the handlebar with at least one hand; they must have to be able to look forward, on each side and to make all necessary maneuvers;
    3. It’s forbidden for cyclists to tow vehicles, keep animals and be towed by other vehicles;
    4. Cyclis must hand push the bike in case of necessity or if causing obstruction or potential danger to pedestrians; in this case they are assimilated to pedestrian and must use common sense and the common prudence.
    5. It’s forbidden to transport people on the bike; respect the nature, not litter paper, bottles and rubbish;
  7. not to hold H&B pursuable for any civil and criminal liability, even if objective, arising from participation in the agreed activities, for any accidents or injuries suffered as a result of accidents caused to oneself or to third parties and sickness (including death or permanent disability) related to the performance of activities and the use of systems and bicycle equipment;
  8. not to hold H&B pursuable for any civil and criminal liability, even if objective, for any accident or illness (including death or permanent disability) occurring during the stay in the Hotel selected by H&B.
  9. not to hold H&B pursuable for any liability for any damage caused to property owned by third parties during the performance of the agreed activity: especially, in case of damges, also in case of theft, of the rented bicycle.
  10. to commit, in the event of loss, damage, theft of the bicycle or any other accessory, to pay H&B the counter value of the lost equipment, stolen or damaged estimated on the basis of the official price lists of the supplier FERCA (Como);
  11. to commit to pay to H&B an amount of Euro 150.00 in the event that it will be necessary to recover and the transport of the customer to the Hotel, except in case the intervention is due to a failure of the bicycle not reliable to the client;
  12. to release H&B of any liability for any loss, damage, theft of my properties occured during the course of the agreed activity.
